1. Acceptance of Terms

By accessing or using GuostPro Cloud PMS (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, then you may not access the Service.

2. Description of Service

GuostPro Cloud PMS provides a cloud-based property management system designed to help property owners and managers streamline their operations. The Service is provided "as is" and we make no representations or warranties of any kind, express or implied, regarding the Service.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of GuostPro and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GuostPro.

5. User Content

By using the Service, you may post, link, store, share, or otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You grant GuostPro a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and GuostPro's business.

6. Prohibited Conduct

You agree not to engage in, or encourage or enable any other user to engage in, any of the following prohibited activities:

• Violating any local, state, national, or international law or regulation.
• Infringing any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Interfering with or disrupting the Service or servers or networks connected to the Service.
• Using the Service for any unauthorized purpose, including collecting usernames and/or email addresses of other users by electronic or other means for the purpose of sending unsolicited email.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the Service or the information, content, materials, or products included on the Service.

9. Limitation of Liability

In no event shall GuostPro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Berlin, Germany, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
